The GDPR compliant use of Usabilla/GetFeedback
First of all, we have to clarify whether consent is required in order to integrate Usabilla/GetFeedback GDPR compliant.
Due to the fact that the integration of Usabilla/GetFeedback is not necessary for the operation of the website, the integration requires consent.
A data processing agreement must be concluded with Momentive Europe UC that meets the criteria of Art. 28 GDPR.
The documents must be archived so that they can be proven to the supervisory authority if necessary.
1. Obtain explicit consent for Usabilla/GetFeedback from users by opt-in
Before Usabilla/GetFeedback becomes active on the website and begins to collect user data, the user must first give their explicit consent. Die Rechtsgrundlage für die Verarbeitung: Ihre Einwilligung nach Art. 6 (1) a DSGVO. Eine Übermittlung von Daten erfolgt: an den Auftragsverarbeiter Momentive Europe UC, 2 Shelbourne Buildings, Second Floor, Shelbourne Road, Dublin 4, Irland. Dies kann auch eine Übermittlung von personenbezogenen Daten in ein Land außerhalb der Europäischen Union bedeuten. Die Übermittlung der Daten in die USA erfolgt aufgrund Art. 45 DSGVO iVm der Angemessenheitsentscheidung C(2023) 4745 der Europäischen Kommission, da sich der Datenempfänger zur Einhaltung der Grundsätze der Datenverarbeitung des Data Pricacy Frameworks (DPF) verpflichtet hat.

5. Formulate the consent in an understandable manner and present it clearly. Do not use dark patterns.
Before the user agrees or rejects the use of Usabilla/GetFeedback, he must be informed in detail about the respective purposes. Therefore, a precisely formulated consent text is of great importance.
